Part 4, Section 8 Normally, persons under the age of 18 cannot be bound by any legal contracts, and therefore would not sign on their own behalf. Their parents or legal guardians would normally sign for them. However, there may be circumstances in which a minor is called upon to sign a legal document which needs a notarization. You may legally notarize a minor’s signature, so long as positive identification is made. The same rules for identification apply just as though you were notarizing an adult’s signature. The minor may have a valid passport or, if the minor is at least 16 years old, he or she may have a valid California driver license. If that is not the case, then you may use credible identifying witness(es).
